The Telegram contacts of the users of the Application will be shared in group chats to which they have subscribed in order to share information related to safety, logistics, weather conditions and other matters pertaining to professional cycling races on the UCI calendar.

The Owner and Data Controller may process usage data collected through this Application to create or update user profiles. This type of processing enables the Data Controller to assess Users’ choices, preferences and behaviour for the purposes specified in the relevant sections of this document.

In addition to the Data Controller, in some cases, the Data may be accessed by other entities involved in the management of this Application (administration, sales, marketing, legal, system administration staff) or external parties (such as third-party technical service providers, couriers, hosting providers, IT companies, communication agencies) also appointed, if necessary, as Data Processors by the Data Controller. Users may at any time request an updated list of Data Processors from the Data Controller.

  • Legal basis for the processing of Data

The Data Controller may process Personal Data relating to Users if one of the following conditions is met:
Users have given their consent for one or more specific purposes; Note: in some jurisdictions, the Data Controller may be authorized to process Personal Data without the User’s consent or any of the other legal bases specified below, until the User objects to such processing (ʻopt-out’). However, this does not apply if the processing of Personal Data is governed by European legislation on the protection of Personal Data;

  • the processing of Personal Data is necessary for the performance of an agreement with the User and/or for any pre-contractual obligations thereof;

Data storage period

Data are processed and stored as long as required by the purposes for which they were collected.
Therefore:

  • Personal Data collected for purposes related to the performance of an agreement between the Data Controller and the User will be stored until the agreement has been fully executed.
  • Personal Data collected for the purposes of the Data Controller’s legitimate interest will be stored as long as needed to fulfil such purposes. Users may find more information about the legitimate interest pursued by the Data Controller in the relevant sections of this document or by contacting the Data Controller.

When the Data are processed on the basis of the User’s consent, the Data Controller may store the Personal Data for a longer period until that consent is withdrawn. Furthermore, the Data Controller may be obliged to store Personal Data for a longer period to comply with a legal obligation or on the order of an authority.
At the end of the storage period, the Personal Data will be deleted. Therefore, the right of access to, erasure, rectification of Personal Data and the right to data portability cannot be enforced after expiration of the storage period.


Purposes of Data processing

User Data are collected to enable the Data Controller to provide its Services on the myCPA app, to fulfil legal obligations, to respond to enforcement requests or actions, to protect its own rights and interests (or those of Users or third parties), to detect malicious or fraudulent activities, and for the following purposes: Hosting and backend infrastructure, Contacting the User, Backup storage and management.

User rights

Users may exercise certain rights with regard to the Data processed by the Data Controller.
In particular, Users have the right to:

  • Withdraw their consent at any time. Users have the right to withdraw consent where they have previously given their consent to the processing of their Personal Data.
  • Object to the processing of their Data. Users have the right to object to the processing of their Data when the Data are processed on a legal basis other than consent. Further details on the right to object are provided in the section below.
  • Access their Data. Users have the right to receive information on the Data processed by the Data Controller, on certain aspects of the processing and to receive a copy of the processed Data.

  • Have their Personal Data deleted or removed. When certain conditions are met, Users have the right to request the erasure of their Data by the Data Controller.
  • Receive their Data and have them transferred to another data controller. Users have the right to receive their Data in a structured, commonly used and machine-readable format and, where technically feasible, to have them transferred without hindrance to another data controller. This provision is applicable when the processing is carried out by automated means and it is based on the User’s consent, on an agreement to which the User is a party or on contractual measures connected therewith.
  • Lodge a complaint. Users have the right to lodge a complaint with the competent data protection supervisory authority or to take legal action.

Where Personal Data are processed in the public interest, in the exercise of public authority vested in the Data Controller or in pursuit of a legitimate interest of the Data Controller, Users have the right to object to the processing on grounds relating to their particular situation.

How to exercise User rights

In order to exercise their rights, Users may address a request to the Data Controller’s contact details indicated in this document. Requests can be submitted free of charge and they shall be addressed by the Data Controller as quickly as possible, in any case within one month.
